Expat Gratuity Rules
Expatriates (foreign workers) are governed by Federal Decree-Law No. 33 of 2021.
Expat Gratuity Calculation:
- First 5 years: 21 days of basic salary per year
- After 5 years: 30 days of basic salary per year
- Maximum: 2 years of basic salary
- Contract type matters (limited vs unlimited)
Payment Source: Employer pays directly from company funds
UAE National Employment Rules
Emirati employees in private sector are covered by General Pension and Social Security Authority (GPSSA).
UAE National Benefits:
- Monthly pension after retirement (NOT lump sum gratuity)
- Retirement age: 60 for men, 55 for women (can work till 65)
- Minimum 20 years service for pension eligibility
- Pension = percentage of last salary (increases with service years)
Payment Source: Government pension fund (GPSSA)

Emirati Pension Contribution Structure
UAE nationals in private sector have monthly deductions:
- Employee contribution: 5% of salary
- Employer contribution: 12.5% of salary

Example: Expat vs Emirati After 10 Years
Both have basic salary of AED 15,000
Expat (Age 35, resigns after 10 years):
First 5 years: (15,000 ÷ 30) × 21 × 5 = AED 52,500
Next 5 years: (15,000 ÷ 30) × 30 × 5 = AED 75,000
Total Lump Sum: AED 127,500 (paid immediately)
Emirati (Age 35, continues till 60):
Works total 25 years (10 already + 15 more till retirement)
Pension = ~70% of last salary (formula varies)
Monthly Pension: ~AED 10,500 (from age 60 onwards for life)
If Emirati lives 25 years after retirement (till 85):
10,500 × 12 months × 25 years = AED 3,150,000 total
Emirati system provides MUCH more long-term security.
Can Emiratis Get Gratuity Instead?
No. If you’re an Emirati working in private sector, you MUST join GPSSA. You cannot opt for expat-style gratuity.
Exception:
Emiratis working in government/military follow different rules (Abu Dhabi Pension Fund, Dubai Pension, etc.)
Early Termination for UAE Nationals
If an Emirati leaves private sector before retirement age:
Worked Less Than 20 Years:
- Get refund of contributions + some employer contributions
- No full pension rights
- Can transfer to government job to continue accumulating
Worked 20+ Years:
- Can get reduced pension from age 60
- Or get partial refund if needed before 60
Mixed Nationality Couples
Common Scenario:
Emirati husband + Expat wife (or vice versa) both working
Result:
- Emirati spouse: Pension system
- Expat spouse: Gratuity system
- Each follows their nationality’s rules
Which System is Better?
Gratuity System (Expats) – Advantages:

Since expats don’t get pension, financial experts recommend:
- Invest your gratuity – Don’t spend it all

Special Case: Expat Converting to UAE National
If you naturalize as UAE citizen while working:
- Previous expat service: Gratuity paid by old employer
- Future service: Joins GPSSA pension system
