What Is Gratuity in the UAE?

Gratuity (also called end-of-service benefit) is a lump-sum payment made by your employer when your employment ends. It is a legal right, not a bonus. Every private sector employee in the UAE who has completed at least one year of continuous service is entitled to it.

It is governed by UAE Federal Decree-Law No. 33 of 2021 (the New Labour Law), which came into effect on 2 February 2022.

Who Is Eligible for Gratuity?

You are entitled to gratuity if you work in the UAE private sector and have completed at least 1 year of continuous service.

Not covered by this law:

  • Federal and local government employees (covered by separate pension laws)
  • Domestic workers (covered by Federal Law No. 10 of 2017)
  • Employees in certain free zones with their own regulations (e.g. DIFC, ADGM)

How Is Gratuity Calculated?

The calculation is based on your basic salary only — not housing allowance, transport, or any other benefits (unless your contract states otherwise).

The Formula

First 5 years: 21 days’ basic salary for each year of service
Beyond 5 years: 30 days’ basic salary for each additional year
Daily wage = Basic monthly salary ÷ 30

Does Resignation Affect Gratuity?

Under the new law (Federal Decree-Law No. 33 of 2021), resignation no longer reduces your gratuity. You receive the same amount whether you resign or are terminated.

What Can Reduce or Cancel Your Gratuity?

Under Article 44 of the New Labour Law, your employer may forfeit your gratuity entirely if you are dismissed for gross misconduct, including:

  • Providing false documents or identity at hiring
  • Causing significant financial loss to the employer
  • Being convicted of a crime involving honour or honesty
  • Disclosing confidential company information
  • Physical assault on the employer or colleagues

A standard resignation or poor performance dismissal does not forfeit gratuity.

Gratuity for Part-Year Service

If your final year of service is incomplete, gratuity is calculated on a pro-rata basis for the months worked.

Example: 6 years and 8 months — full 6 years calculated normally, then (8 ÷ 12) × 30 days’ salary added on top.

When Must Your Employer Pay Gratuity?

Your employer must pay all end-of-service entitlements within 14 days of the contract end date. If delayed or refused:

  1. File a complaint via the MOHRE app or mohre.gov.ae
  2. Call MOHRE on 800-60
  3. Escalate to the labour court if unresolved within 14 days

Free Zone Employees

Employees in DIFC and ADGM are governed by their own employment laws. Some free zones have introduced DEWS or similar workplace savings schemes as alternatives to traditional gratuity.
