What Is the Notice Period in UAE?

Under the new law, the minimum notice period is 30 days and the maximum is 90 days. Your employment contract will specify the exact notice period, which must fall within this range.

Are You Paid During Notice Period?

Yes. You must receive your full basic salary throughout the notice period, whether you are working or on garden leave (asked not to come in). Your employer cannot make you forfeit notice period pay.

Does Notice Period Count Toward Gratuity?

Yes. If you serve your full notice period, those days are included in your total service period for gratuity calculation.

Can You Leave Before Notice Period Ends?

If you leave before completing your notice period, your employer may deduct the equivalent salary for the unserved notice days. However, they cannot withhold your gratuity or leave encashment as compensation.

Can the Employer Waive the Notice Period?

Yes. An employer can waive the notice period and pay you in lieu of notice (PILON). In this case, you receive your salary for the notice period without working those days, and your end date is immediate.

What if my contract says notice period is less than 30 days?

Any contract term below the 30-day minimum is invalid. UAE law overrides it and you are entitled to a minimum 30-day notice period.

Can I take annual leave during my notice period?

Yes, with employer agreement. If your employer asks you to use your remaining leave during the notice period, that is permissible — but they cannot then refuse to pay the encashment for the same days twice.
