Part-Time Employee Gratuity Rights Under UAE Law
Many part-time workers in the UAE assume they are not entitled to end-of-service gratuity. This is incorrect. Federal Decree-Law No. 33 of 2021 explicitly covers part-time employees, and the gratuity formula is the same as for full-time workers — the only difference is that a part-time salary is typically lower, which affects the final amount.

What the Law Says
Article 51 of Federal Decree-Law No. 33 of 2021 defines gratuity entitlement for all employees under UAE Labour Law, with no exclusion for part-time workers. The law also separately defines part-time work in Article 1 as employment where working hours are less than the full-time standard (48 hours per week / 8 hours per day).
Both categories receive the same statutory entitlements, calculated proportionally based on their agreed basic salary.
The Gratuity Formula (Same for Both)
- First 5 years of service: 21 days of basic salary per year
- After 5 years: 30 days of basic salary per year
- Maximum: 2 years of basic salary
- Minimum service required: 1 year
Example 1: Part-Time Employee (4 Hours/Day)
Sara works 4 hours per day, 5 days a week. Basic salary: AED 4,500/month. Service: 4 years. Limited contract.
(4,500 ÷ 30) × 21 × 4 = AED 12,600
Example 2: Full-Time Employee (Same Years)
Ahmed works 8 hours per day, 6 days a week. Basic salary: AED 9,000/month. Service: 4 years. Limited contract.
(9,000 ÷ 30) × 21 × 4 = AED 25,200

Multiple Part-Time Jobs
If you work part-time for two different employers simultaneously, each employer calculates and pays gratuity independently. You cannot combine service periods across employers. Each employment relationship is treated separately, and you must meet the one-year minimum with each employer individually.
Annual Leave for Part-Time Workers
Part-time employees accrue annual leave proportionally to their working hours compared to a full-time employee. A full-time employee gets 30 days per year; a part-time employee working half the hours receives 15 days. Unused annual leave at the end of service must be paid out (leave encashment) — this is separate from gratuity.

Part-Time vs Freelancer: A Critical Distinction
Whether you are entitled to gratuity depends heavily on your employment status. The distinction between a part-time employee and a freelancer matters significantly:

If your employer tries to classify you as a contractor to avoid paying gratuity, but you actually work regular hours under supervision, this may constitute misclassification — a violation of UAE Labour Law.
What If Your Employer Refuses to Pay?
Non-payment of gratuity to eligible part-time employees is illegal. Take the following steps:
- Send a written request citing Article 51 of Federal Decree-Law No. 33 of 2021
- If refused, file a complaint via the MOHRE portal or call 800 60
- MOHRE will investigate and can enforce payment plus potential fines against the employer
- If unresolved, MOHRE refers the case to the labour court at no initial cost to you
Sick Leave and Other Benefits
Part-time employees are also entitled to:
- Sick leave: Proportional to working hours (same tiers as full-time: paid, half-pay, unpaid)
- Public holidays: If the public holiday falls on a scheduled working day, you are paid for it
- Notice period: Same as full-time — 30 days minimum under the 2021 law
- End-of-service settlement: Gratuity + leave encashment, to be paid within 14 days of last working day

Yes, provided you have worked for the same employer for at least one full year under a valid employment contract. Your entitlement is calculated on your basic monthly salary using the same formula as full-time workers.

Check your contract. If it is an “employment contract”, you are an employee. Also check your residence visa — if it was sponsored by the company as an employee, you have employment status. A true contractor has a freelance permit and invoices clients independently.
