Understanding Basic Salary vs Gross Salary for Your Settlement

What is Basic Salary?

Basic salary is the FIXED amount stated in your employment contract before any additions. It usually appears as “Basic Salary” or “Base Salary” in your contract.

What Basic Salary Includes:

  • Your agreed monthly fixed amount
  • Nothing else

That’s it. Really simple.

What is Gross Salary?

Gross salary = Basic Salary + ALL Allowances

Common Allowances in UAE:

  • Housing allowance
  • Transport allowance
  • Phone allowance
  • Education allowance (for children)
  • Utility allowance
  • Food allowance
  • Performance bonuses
  • Commission

Salary Breakdown Example

Ahmed’s salary slip:

Basic Salary: AED 8,000
Housing Allowance: AED 4,000
Transport Allowance: AED 1,000
Phone Allowance: AED 500
Gross Salary: AED 13,500

Which One is Used for Gratuity?

ONLY BASIC SALARY

According to Federal Decree-Law No. 33 of 2021, Article 51:

“Gratuity shall be calculated on the basis of the basic wage last received by the Worker.”

All allowances are excluded.

Real Calculation Comparison

Using Ahmed’s example above (5 years service):

WRONG Calculation (using gross salary):
(13,500 ÷ 30) × 21 × 5 = AED 47,250

CORRECT Calculation (using basic salary):
(8,000 ÷ 30) × 21 × 5 = AED 28,000

Difference: AED 19,250 less than expected!

Why This Matters

If your basic salary is low compared to allowances, your gratuity will be much less than you expect.

Two Employees, Same Take-Home Pay:

Employee A:
Basic: AED 10,000
Housing: AED 2,000
Transport: AED 1,000
Total: AED 13,000

Employee B:
Basic: AED 6,000
Housing: AED 5,000
Transport: AED 2,000
Total: AED 13,000

Gratuity After 5 Years:

Employee A: (10,000 ÷ 30) × 21 × 5 = AED 35,000
Employee B: (6,000 ÷ 30) × 21 × 5 = AED 21,000

Employee A gets AED 14,000 MORE even though both earn same monthly amount!

How to Check Your Basic Salary

Look at these documents:

  1. Employment Contract – Check “Basic Salary” or “Base Salary” field
  2. Salary Certificate from HR
  3. Monthly Salary Slip – Should show breakdown
  4. MOHRE Contract – Basic salary is stated here

If your contract doesn’t clearly separate basic salary from allowances, this is a RED FLAG.

Employer Tricks to Watch For

Trick 1: Low Basic, High Allowances

Some employers keep basic salary very low (like 40% of total) to reduce gratuity liability.

Example:
Total: AED 15,000
Basic: Only AED 6,000 (40%)
Allowances: AED 9,000

Your gratuity is calculated on just AED 6,000.

Trick 2: Calling Basic Salary “Gross Salary”

Some contracts say “Gross Salary: AED 15,000” but don’t show breakdown. Later, employer claims AED 8,000 is basic and AED 7,000 is allowances.

Protection: Always insist on contracts that clearly show:

  • Basic Salary: AED X
  • Housing Allowance: AED Y
  • Transport Allowance: AED Z

What If Contract Only Shows Total Salary?

If your contract says “Monthly Salary: AED 15,000” with no breakdown:

  • UAE law assumes the ENTIRE amount is basic salary
  • This works in your favor for gratuity
  • Employer cannot later claim part was “allowances”

Special Cases

Commission-Based Salaries:

If you earn commission or variable pay, gratuity is based on average of last 12 months salary.

Salary Increases:

Your gratuity uses your LAST basic salary (most recent) for entire service period.

Example:
Year 1-3: Basic was AED 6,000
Year 4-5: Basic increased to AED 10,000

Gratuity calculation uses AED 10,000 for all 5 years – great for you!

Negotiate Better Basic Salary

When accepting job offer:

Instead of: Basic AED 6,000 + Housing AED 4,000 = AED 10,000

Negotiate for: Basic AED 8,000 + Housing AED 2,000 = AED 10,000

Same take-home pay, but your gratuity will be 33% higher!
